        In Illinois, if you are deemed 50% at fault or more, you will not be allowed to receive any compensation. This is the way the law works. If you were deemed at fault for anything under 50% at fault you can receive a reduced compensation award.

        Going back to the original example of someone going slightly over the speed limit but being hit by a truck driver who was driving drowsy, we need to look at how that would affect compensation. Let’s say that your damages and injuries came out to be $100,000. Let’s also say that the insurance company successfully blamed 20% of the fault on you for causing the accident. If that were to happen, then 20% of your compensation award would no longer be yours. You would collect $80,000 of your $100,000 award to account for your fault in the accident.
